Bankrupt Justice (Entry Added 18.Oct.11)

Judging by Israel’s latest deal with Hamas, most people would infer that one Jewish soldier is worth one thousand Arab murderers. I see it the other way around. These Arabs murdered hundreds of Jews in cold blood and are being pardoned for their crimes and released from prison. Their lives were already declared to be worth more than their Jewish victims when they were allowed to live, albeit in prison. Now the blood of their Jewish victims is declared to be worthless, as they are being absolved of their crimes and sent free.

To put this into proportion, I will give one example. An Arab took a kitchen knife and stabbed a Jewish girl to death in broad daylight, because she is Jewish. That Arab was apprehended, tried and convicted to life in prison. Instead of being hung or stoned to death, as is required by his blood guilt, the Arab was allowed to live in Israel, where he was housed, fed, and guarded at the expense of the Israeli taxpayer. The parents of the innocent Jewish girl, whose blood cries from the ground for justice, began paying his room and board with the taxes they are forced to pay to their government. Along came some more Arabs, who tunneled into an army base, killed some soldiers and kidnapped another. They demanded the freedom of that same Arab murderer as payment for the release of their hostage. Suddenly the picture was turned upon its head. People said, “The Arab who took a life can be traded to save a life, is this not a worthy compromise?” I say, “No, it surely is not. The means do not justify the end, and even the end is objectionable.”

This difficult question has already been Asked long ago and the answer was Provided with a flood. God Created Adam and Eve, who gave birth to Cain and Abel. Cain envied his brother’s success and despised him for making him feel of lesser merit. But Cain found a way to get rid of his problem, and murdered Abel. As punishment, God did not kill Cain, but banished him from his Presence, and even cursed the ground beneath his feet, causing him to wander from place to place. The “Mark of Cain” was Invented, which Said that anyone who kills Cain would be avenged sevenfold. The murderer spared by God multiplied his sins in the world until there was nearly nothing left of mankind to be spared. This forced God to flood the earth and make the world anew. The second time around the lesson was internalized: Murderers may not be spared. They must be executed by men.

Why do you suppose God spared Cain? Could it be a high regard for life? Might this be an overvaluation of the living and an undervaluation of the dead? You may say, “The dead cannot be saved with death, but life can be saved with forgiveness,” yet apparently this is incorrect. The death of murderers saves lives, giving value to life and honoring the living memory of the dead. On the other hand, sparing murderers brings death to the living, devaluating life and demeaning the memory of the dead.

You cannot spare a murderer, even if his life may be traded for the freedom of a hostage, because his life does not belong to you. It is the responsibility of men to execute murderers. If this responsibility is not met it will remain a stain on our hands, a curse upon our land, and a mark upon the living. With time it will require massive cleansing and flooding to scrub our society down to its foundations and built it anew, and if this fails, it will happen again and again, until the lesson is internalized once and for all: Murderers may not be spared. They must be executed by men.

Or if he struck him with a hand-sized wood implement by which one could die, and he died, he is a murderer; the murderer shall surely be put to death. The avenger of the blood, he shall put the murderer to death; when he encounters him, he shall put him to death. If he pushed him out of hatred or hurled upon him from ambush, and he died; or in enmity struck him with his hand and he died, the assailant shall surely be put to death, he is a murderer; the avenger of the blood shall put the murderer to death when he encounters him." (Numbers 35:16-21).

"One who strikes a man, so that he dies, shall surely die. But for one who had not lain in ambush and the Lord had caused it to come to his hand, I shall provide you a place to which he shall flee. Yet if a man shall act intentionally against his fellow to kill him with guile, even from My Altar shall you take him to die." (Exodus 21:12-14).

"And a man who mortally strikes any man shall surely be put to death." (Leviticus 24:17). "Any condemned person who has been banned from mankind shall not be redeemed; he shall be put to death." (Leviticus 27:29). "'Accursed is one who strikes his fellow stealthily,' And all the people shall say, 'Amen.'" (Deuteronomy 27:24).
